By accessing our website or requesting or accepting services from us, you agree to these Terms. Please read them carefully. If you do not agree, please do not use our website or services.
Your use of this website and any request for services from Cerritos Concrete & Masonry constitutes your acceptance of these Terms. We reserve the right to modify these Terms at any time. Cerritos Concrete & Masonry provides concrete and masonry contracting services to residential and commercial property owners in Cerritos, CA and surrounding communities. Our services include but are not limited to: foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, brick wall installation, stone masonry, and related work.
All services are performed by licensed and insured contractors. We reserve the right to decline any project request at our discretion. Nothing on this website constitutes a binding offer to perform services. A project only begins after a written proposal has been issued and signed by both parties.
We provide free on-site estimates for projects within our service area. An estimate is an approximation of cost based on the information available at the time of the assessment. Estimates are not binding contracts.
A written proposal sets out the scope of work, materials, and pricing. Once both parties have signed the written proposal, that document governs the work to be performed and the agreed price. If unforeseen conditions are discovered after work begins - such as hidden damage, buried utilities, or soil conditions not visible during the initial assessment - we will notify you before proceeding and obtain your written approval for any cost changes.
Prices quoted are valid for 30 days from the date of the written proposal unless otherwise stated. Material price fluctuations beyond our control may affect final pricing if work does not commence within the validity period.
Project scheduling is confirmed in writing at the time of proposal acceptance. We will make reasonable efforts to meet the agreed schedule. We are not liable for delays caused by weather, permit processing timelines, supplier delays, or other factors outside our control. We will notify you promptly of any schedule changes.
You may cancel a scheduled project by providing written notice at least 48 hours before the scheduled start date. Cancellation after materials have been ordered or work has begun may result in charges for materials purchased and labor performed up to the point of cancellation.
We reserve the right to reschedule or cancel a project at any time due to weather conditions, crew availability, or other circumstances. If we cancel, we will reschedule at the earliest mutually convenient time.
Payment terms are stated in the written proposal. Unless otherwise agreed in writing, a deposit may be required before work begins, with the balance due upon project completion. All invoices are due upon receipt unless the proposal specifies a different payment schedule.
Accepted payment methods will be stated in your written proposal. Late payments may be subject to a late fee as permitted under California law. We reserve the right to suspend or withhold work on a project where payment is overdue.
California law (the Mechanics Lien Law) gives contractors and suppliers the right to file a lien on your property if they are not paid for work performed. We comply with all applicable preliminary notice and lien law requirements.
Specific warranty terms for each project are stated in the written proposal. Where a warranty is provided, it covers defects in workmanship for the period specified. Warranty coverage does not extend to:
Except as expressly stated in a written proposal, all work is provided "as is" and we make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Cerritos Concrete & Masonry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our website or services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to services we perform shall not exceed the total amount you paid us for the specific project giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
By accepting our services, you grant us permission to access your property for the purpose of performing the agreed work. You are responsible for ensuring the work area is reasonably clear and safe to access. You are also responsible for informing us of any known underground utilities, buried pipes, drainage systems, or other subsurface conditions at the site before work begins.
We are not liable for damage to underground utilities, irrigation lines, or other subsurface features that were not disclosed to us prior to commencing work.
If you have a dispute with us regarding any service or project, we ask that you contact us first at info@cerritosconcreteandmasonry.com so we have an opportunity to resolve the issue directly. Most disputes can be resolved through a direct conversation.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any other legal remedy. Mediation shall take place in Cerritos, California. If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of a mutually agreed arbitration provider, or through a court of competent jurisdiction in California.
These Terms and any agreements for services are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in California.
